General Terms and Conditions for Distance Selling by Attrē GmbH

Scope of Application

The present General Terms and Conditions exclusively apply to the business relations between the customer and the Attrē GmbH in distance selling, in the version that is current at the time the contract is concluded. Distance contracts are contracts between businesses or between a business and a consumer, concluded without both parties being physically present. These are formed within a distribution or service system organized for distance selling, wherein only distance communication means are used. The term "distance communication means" includes, but is not limited to, the internet and electronic mail (Email).

Conditions differing from the purchaser are not recognized by Attrē GmbH.

The current version of the general terms and conditions can be viewed on the Attrē GmbH website (www.attrejewelry.com). The version valid on the day of the order applies!

Conclusion of Contract

The products presented in the online shop at www.attrejewelry.com do not constitute legally binding offers by Attrē GmbH.

A contract is formed through an offer by the customer and acceptance by Attrē GmbH. Your offer is made by transmitting the order form provided on the website www.attrejewelry.com by Attrē GmbH, fully completed. Attrē GmbH confirms receipt of the order by sending a confirmation email to the customer, detailing the products, as well as the price, delivery, and payment conditions. This automatically dispatched order confirmation does not constitute acceptance of the offer but is merely intended to inform about the receipt of the order.

Acceptance of the offer is only completed when the ordered products and services are shipped to the customer. We confirm the shipment via an email.

Rejection of Orders

Attrē GmbH reserves the right to decline orders. If Attrē GmbH does not execute an online order, it will promptly notify the purchaser. All customer notifications related to online orders are made via email.

Right of Withdrawal of the Customer

a) The customer, being a consumer as defined in § 1 Para 1 of the Distance and Off-Premises Business Act (FAGG), has the right to withdraw from a distance contract without stating reasons within 14 days. This period starts on the day the customer, or a third party designated by the customer, who is not the carrier, has taken possession of the goods.

The declaration of withdrawal is not tied to a specific form. To exercise the right of withdrawal, the customer can use the following withdrawal form, which is also available on the homepage at www.attrejewelry.com, or send another declaration stating the withdrawal (letter, fax, or email) to Attrē GmbH (Attrē GmbH, Seilerstätte 2/26, 1010 Vienna, Austria, E-mail: office@attrejewelry.com). Returning the goods without any further explanation is also deemed a withdrawal.

To observe the 14-day withdrawal period, it is sufficient for the declaration of withdrawal or the return of goods to be sent within this timeframe. The return of goods is at the customer's expense.

b) In particular, the customer does not have a right of withdrawal for contracts concerning:

Goods made to the customer's specifications (custom-made) or clearly tailored to the customer's personal needs.

Goods delivered sealed and if their seal was removed after delivery.

c) When exercising the right of withdrawal, Attrē GmbH has to refund payments made by the customer, including delivery costs (with the exception of additional costs resulting from the customer choosing a type of delivery other than the cheapest standard delivery offered by Attrē GmbH), without undue delay and in any event not later than 14 days from the day on which Attrē GmbH is informed about the decision to withdraw from this contract. For this repayment, Attrē GmbH will use the same means of payment that the customer used for the initial transaction, unless expressly agreed otherwise; in any event, the customer will not incur any fees as a result of this repayment. Attrē GmbH may withhold repayment until it has received the goods back, or the customer has supplied evidence of having sent back the goods, whichever is the earliest.

The customer must send back or return the goods to Attrē GmbH without undue delay and in any event not later than 14 days from the day on which the customer communicates the withdrawal from this contract. The deadline is met if the customer sends back the goods before the 14-day period has expired. The costs of returning the goods are borne by the customer.

The customer is liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Delivery/Shipping Costs

Processing and subsequent delivery of ordered goods will take place – unless otherwise declined as per Section 3 – within a maximum of 4 to 6 weeks (excluding postal service duration) from the receipt of the order.

We offer free worldwide shipping.

Should the customer expressly desire a special shipping method, Attrē GmbH will charge the additional costs incurred. Specific shipping requests must be made for each order.

For self-pickup in Vienna, the pickup date must be scheduled in advance via email at office@attrejewelry.com.

Prices and Payment Methods

All prices listed by Attrē GmbH, unless otherwise expressly noted, are gross prices inclusive of VAT for customers from the European Union. Customers outside the European Union do not pay VAT.

Payment upon contract conclusion can be made using the following methods:

  • Credit Card (Visa, Mastercard)
  • Instant Transfer (to be received within 14 days from the order date)
  • Paypal

In case of payment delay, default interest at the statutory rate will be charged, and EUR 10.00 will be invoiced for each reminder. Customers bear the direct costs of returning the goods.

Warranty and Liability

a) Attrē GmbH is liable for defects present at the time of delivery in accordance with statutory provisions. For contracts with end consumers, the warranty period is 2 years starting from the customer receiving the goods. During the legal warranty period, you initially have the right to free rectification or replacement. If a defect cannot be rectified within a reasonable time, the customer has the option to rescind (reverse the purchase) or reduce (lower the purchase price). Typical industry materials are used for the distributed products. Therefore, colors, materials, and lightfastness are of usual average durability.

For business customers as per the Consumer Protection Act, the warranty is limited to 6 months.

b) Attrē GmbH is not liable for damages, irrespective of the legal reason, particularly due to delay, impossibility of performance, positive breach of duty, fault upon contract conclusion, consequential damage due to defects, or unlawful acts, resulting from slight negligence. Business customers as per the Consumer Protection Act have the burden to prove gross negligence or intent. For contracts with consumers, this liability exclusion does not apply to damages to persons and goods accepted for processing.

Complaint Procedure

Retention of Title and Set-Off Prohibition

The delivered goods remain the full property of Attrē GmbH until the complete payment of the purchase price and shipping costs.

The offsetting of counterclaims of the customer against claims of Attrē GmbH is expressly excluded.

Applicable Law

All contracts between Attrē GmbH and a customer are governed exclusively by Austrian substantive law.

The place of performance for deliveries and payments is Vienna.

For disputes arising from contracts with customers, the jurisdiction is Vienna (Austria), unless mandatory statutory provisions specify a different jurisdiction.

Severability Clause

Should individual provisions of these general terms and conditions be or become wholly or partly invalid or unenforceable, this does not affect the validity of the remaining terms.
